The Protection of Women from Domestic Violence Act, 2005 lets a woman get protection orders, the right to stay in the shared home, money for expenses, and custody of children, quickly and through a Magistrate.
A wife, children or parents who cannot support themselves can ask a Magistrate to order monthly maintenance from a husband, father or son who has enough means, under Section 144 of the BNSS. Interim maintenance can be ordered while the case runs.
When both husband and wife agree to separate, they can file a joint petition for divorce by mutual consent. Here are the conditions, the two motions, the six-month waiting period and when courts can waive it.
